The Federal Government requires auditing on HSA accounts to ensure that they are fully eligible. EMPOWER uses a third party provider to satisfy these requirements and validate the information provided is correct and belongs to the Consumer. In some cases, this third party provider will require the consumer to provide supporting documentation.
Types of Information That May Require Verification
To validate a new HSA, the following information must exist in the EMPOWER system. In some instances, this information must also be confirmed by Consumer-provided documentation.
- Address
- Name
- Date of Birth
- Social Security Number
- Non-Resident Alien
Verification Process
When additional information is needed, EMPOWER will send the Employer an email stating what information needs to be verified with supporting documentation. It is the Employer’s responsibility to inform the Participant Consumer to submit the information. The Participant Consumer will then need to provide supporting documentation via the Consumer Portal.
To upload the documents to the Consumer Portal, please:
- Log into the Consumer Portal
- On the main page, scroll to the Tasks section
- Click on Upload Documents to upload the documents required in the below matrix:

Non Verified Accounts
Consumers have 60 days from the account creation date to submit proper documentation. If this is not completed within 60 days, EMPOWER will close the HSA accounts and return the funds via ACH to the Employer. It is the responsibility of the Employer to return the funds to the Account Holder and adjust the W2.
EMPOWER will send an email with instructions to the Employer when the account is closed.
Consumers will be required to re-enroll in the HSA if they wish to participate in the the HSA after account closure.
